Limited Warranty

Thank you for choosing or considering KETTLER. This KETTLER Limited Warranty (“Limited Warranty”) is provided to Kettler customers (“you” or “Customer”) by Kettler International, Inc. (“Kettler”). This Limited Warranty is a limited warranty on the terms and conditions, and for the term, set forth below. This Limited Warranty applies to goods sold by Kettler under the KETTLER, Kiddi-o or Halo brands and goods sold under other brands that Kettler distributes on a national level (the “Products”). This Limited Warranty is not transferrable and does not benefit any person other than you.

Warranty Period

The warranty period (“Warranty Period”) commences from the date of purchase through the warranty time period specific to each model and/or specific to particular components of each model listed in the item’s owner manual or KETTLER advertised item specifications. When not specified, the Warranty Period will be one year for residential use and 90 days for non-residential use. Replacement of defective Products or components thereof does not extend the Limited Warranty which starts on the original date of purchase.

Our Responsibility

During the Warranty Period, KETTLER warrants this product to be free from any material, verifiable and reproducible defects in material or workmanship that materially impacts the intended use of the Product (but excluding any condition described in the “What is Not Covered by the Warranty?” section below). The Limited Warranty extends to the replacement of the defective component or part. KETTLER reserves the right to substitute products or parts of comparable quality and value or, where permissible by law, to use or deliver refurbished or recertified products or parts in the repair or replacement of any product or part. If the warrantied Products or parts are no longer manufactured or available and no other products or parts of comparable quality and value are available, KETTLER reserves the right, in its sole discretion, to satisfy its obligations hereunder by refunding the value of the warrantied Product or part. The removal of defective and installation of warrantied items or components are owner’s responsibility. Any shipments made under this Limited Warranty will be shipped to the contiguous United States or provincial Canada only. Any shipment outside of those areas will be at the sole cost of the customer.

What Is Not Covered by This Limited Warranty?

  • Normal wear and tear, wrong assembly, damage through misuse or improper storage, negligence, abuse, shipping damage, acts of nature including wind and freezing, mildew, failure to timely mitigate, or use of corrosive products for maintenance.
  • Failing to follow instructions supplied with the Product.
  • Fading of finish including graphics due to sun exposure.
  • Change of color or lifting of the grain of natural wood as it ages.
  • Used as a rental.
  • Modified or repaired by anyone not authorized by KETTLER.
  • Products purchased in used condition.
  • Products purchased from a reseller (an entity that did not buy the product wholesale directly from KETTLER).
  • When you are not the original purchaser.
  • Cost of any labor.
  • Return shipping except for exceptions noted below.

In addition to the exclusions listed, the following are not deemed defects: scratches, dings, dents, scuffs, cosmetic blemishes, surface rust, finish fading, color change, wheel wear, drive belts, lightbulbs, springs, electronics, fading or stretching of fabrics, or non-durable parts (such as nets, wheels, handles).

Limitations and Disclaimers

This Limited Warranty only applies to the retail purchaser of new, unused products and is authenticated by proof of purchase from a retailer located in the United States or Canada. This Limited Warranty is only valid for products that remain within the contiguous United States or provincial Canada. At no time will we be responsible for any incidental expenses or costs incurred by you related to or arising from warranted defects in or the performance of the product.

The warranties and associated remedies outlined herein are the sole and exclusive warranties provided hereunder. other than the express Limited Warranty set forth herein, KETTLER and its suppliers and affiliates make no other and hereby disclaim all warranties, whether express or implied, including but not limited to warranties of merchantability and fitness for a particular purpose. No advice or information, whether oral or written, obtained from KETTLER or elsewhere will create any warranty, condition or binding agreement not expressly stated in this agreement.

To the extent permitted by the applicable law, KETTLER will not be liable to you or any third party, nor will KETTLER indemnify you or any third party, for any incidental, indirect, exemplary, special, consequential, or punitive damages, regardless of the nature of the claim even if advised or otherwise being aware of the possibility of such damages and even if such damages are a direct result of KETTLER’s negligence.

Determination of the suitability of the Product for the use and application contemplated by you and others shall be your sole responsibility. You assume all risk and liability for results obtained by the use of the Product, whether used singly or in combination with other products or services.

Prior written or oral statements, negotiations, communications or representations regarding warranties have been merged into or superseded by this writing, and if not included in this writing, they shall not be binding. This is the total agreement about any and all warranties provided by Kettler relating to the Products. This Limited Warranty does not constitute a written affirmation of fact or promise by Kettler that the material or workmanship of a Product is free of any defects or will meet a specified level of performance, duration, or use.

How to submit a claim under this Limited Warranty

You can submit a claim under this Limited Warranty as follows:

  1. Submission:
    • To initiate a warranty claim, contact KETTLER Customer Service via email at parts@kettlerusa.com.
    • Provide your name, address, daytime telephone number, model number, and name of the product, a description of the problem, and a photo of the issue.
  1. Verification:
    • KETTLER may request proof of purchase to validate the warranty claim.
  1. Shipping Responsibility:
    • Customers are responsible for costs and labor of repackaging and shipping the product back to KETTLER for warranty claim validation if requested by KETTLER. If deemed defective, KETTLER will reimburse the cost of standard shipping.
    • KETTLER may pay for shipping for out-of-the-box defects when notice is received within 30 days of original purchase.

This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
